The Supreme Court has issued Notice on the Public Intesrest Litigation for Implementation of Land Pooling and Green Development Area Policies to the Lieutenant Governor of the National Capital Territory of Delhi and the Vice Chairman of the Delhi Devlopment Authority amongst other relevant authorities.
The PIL was filed under Article 32 of the Constitution of India, on behalf of the Delhi Dehat Vikas Manch, a registered society having more than 700 members, across the capital city committed to the upliftment of the farmer community and the sustainable development of rural areas within the National Capital Territory (NCT) of Delhi.
The plea petitioned for an implementation of the Land Pooling Policy and Green Development Area (GDA) Policy, earlier LDRA, in New Delhi as outlined in the Master Plan 2021 and Draft Master Plan 2041.
The petition sought time-bound implementation of both the Policies as it is essential for planned urban development and environmental protection as envisioned in the Master Plan of Delhi 2021 and Draft Master Plan 2041.
The petition further called for the establishment of an expert committee to oversee the implementation of these policies which would include representatives from all relevant stakeholders, including the Petitioner Society. ‘
The Petitioner society was represented by Ashwarya Sinha, Advocate on Record, and Govind Rishi, Advocate.
The matter was heard before the bench of Justice Surya Kant and Justice Ujjal Bhuyan.
