The high court on Wednesday issued notices to the state govt in the petition filed by former director of mines and geology V G Venkat Reddy seeking directions to set aside the suspension order and the order initiating disciplinary proceedings against him.
The state govt initiated disciplinary proceedings against Venkat Reddy on August 21 and suspended him from service on August 31.
Challenging these orders, Venkat Reddy moved the high court, contending that his deputation to the state govt had ended on August 31 and the state govt lacked jurisdiction to suspend him on the same day.
The counsel for Venkat Reddy argued that the petitioner had joined his parent department on September 1. Placing him under suspension is beyond the jurisdiction of the state govt as he was relieved from state service on the same day.
He also contended that initiating disciplinary proceedings under the state govt service rules was inappropriate, arguing that any disciplinary proceedings should be initiated according to the All India Service rules only.
Considering the submissions of Venkat Reddy, the high court asked the state govt to submit all details pertaining to the case and posted the matter for further hearing on October 14.
Venkat Reddy is facing allegations of misusing his official position in allotting mining tenders.
