The Delhi High Court while dismissing the Petition for being based on misleading information found no violation of natural justice in the Financial Commissioner’s proceedings.
The court observed that the Commissioner thoroughly examined the case, including the Petitioner’s submissions, the Administrator’s report, and the Crime Branch’s Inquiry Report.
The Court further noted that the S.K. Gambhir judgment clarifies that membership starts only when the application is accepted, not based on payment or application submission date.
The Writ Petition was filed seeking the setting aside of an order passed by the Financial Commissioner in a Revision Petition as well as an order passed by the Assistant Registrar, Office of Registrar, Cooperative Societies whereby the name of Joginder Kaur was forwarded for holding the draw of lots for allotment of the subject matter plot.
The Petitioner had also filed a Revision Petition before the Financial Commissioner and the same was dismissed on merit.
